After specific notification by the department, the right holder shall install a suitable measuring device or shall enter into an agreement with the department to determine the amount of water diverted from power records and shall annually report the information to the department.

This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.
Point of diversion is located within Lot 5, Blk. 1, Bennett Mountain Subdivision #1.
Places of use are located within Lot 3 and Lots 7-10, Blk. 1; Bennett Mountain Subdivision #1.
Domestic use is for 5 homes.
Domestic use does not include lawn, garden, landscape, or other types of irrigation.
The domestic use authorized under this right shall not exceed 13,000 gallons per day per dwelling in accordance with Section 42-111, Idaho Code.
The irrigation use occurring under this right shall not exceed 1/2 acre within each platted subdivision lot upon which a home has been constructed.

This right when combined with all other rights shall provide no more than 0.03 cfs per acre nor more than 4.0 afa per acre at the field headgate for irrigation of the place of use.
