This right when combined with all other rights shall provide no more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
X35
Rights 57-248, 57-252, 57-262, 57-1068, 57-1070, 57-1074, 57-2085, 57-2296, 57-2325, 57-7400, 57-7454, 57-7472, 57-7525, 57-7532, 57-7583, 57-11514 and 57-11516 when combined shall not exceed the irrigation of 281 acres.
R05
Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 57R.
The combined annual storage volume under rights 57-7525, 57-7583, and 57-7610 shall not exceed 340 af.
The irrigation storage season of use authorizes the active storage of water into the reservoir from 11/15 to 3/15 only. However, the water right holder is not required to completely empty the reservoir after 3/15 each year.
G03
Water diverted under this right is either used on the place of use described herein, or may be exchanged by simultaneously releasing storage water under this right into Macks Creek at the point of injection described above, and diverting an equal amount from Macks Creek and/or Reynolds Creek at the point(s) of rediversion described above.
020
The diversion and use of water described in this right may be subject to additional conditions and limitations agreed to by the protestant and the right holder under a separate agreement to which the Department is not a party. Because the Department is not a party, the Department is not responsible for enforcement of any aspect of the agreement not specifically addressed in other conditions herein. Enforcement of those portions of the agreement not specifically addressed in other conditions shall be the responsibility of the protestant and the water right holder.
103
When ordered by the Director, the right holder shall provide mitigation acceptable to the Director to offset depletion of lower Snake River flows needed for migrating anadromous fish. The amount of water required for mitigation, which is to be released into the Snake River or a tributary for this purpose, will be determined by the Director based upon the reduction in flow caused by the use of water pursuant to this right. Any order of the Director issued in accordance with this paragraph shall be in conformance with applicable rules allowing the right holder due process as the need for mitigation and the amount of mitigation are determined.
R43
The right holder shall maintain measuring devices approved by the Department at the points of rediversion. The right holder shall also maintain measuring devices approved by the Department to accurately measure the inflow and outflow from Lower Macks Creek Reservoir.
