This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.0 afa per acre at the field headgate for irrigation of the lands above.

This right does not grant any right-of-way or easement across the land of another and specifically does not grant utilization of the Bruneau-Buckaroo Ditch.

This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.

Water delivered by the Bruneau-Buckaroo Cooperative Ditch Company is also used to irrigate 250 acres of the place of use for this right. When Bruneau-Buckaroo Cooperative Ditch Company water becomes available for delivery to the 250 acres, the use of water pursuant to this right shall be reduced to a diversion rate of 15.20 cfs for the irrigation of the remaining 760 acres. Consequently, this right when combined with Bruneau-Buckaroo Cooperative Ditch Company Rights 51-2, 51-3, 51-5, 51-10350, 51-10351 & 51-10271 shall not exceed the irrigation of 3,491.2 acres.

Ground water rights 51-2089B, 51-2091, 51-2120, 51-2123, 51-2127, 51-2150, 51-2165, 51-2169, 51-2170, 51-2213B, 51-7047, 51-7058, and 51-7082A are also used to irrigate 760 acres of the place of use for this right. When this right is authorized for use on 1010 acres, it shall not exceed a total combined diversion rate of 21.01 cfs and the irrigation of a combined total of 1050.4 acres when used in combination with the ground water rights listed in this condition. When this right is authorized for use on 760 acres, it shall not exceed a total combined diversion rate of 16.01 cfs and the irrigation of a combined total of 800.4 acres when used in combination with the ground water rights listed in this condition.

The right holder shall maintain a totalizing measuring device of a type approved by the Department as a part of the diverting works.

After specific notification by the Department, the right holder shall record the quantity of water diverted or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.
