176 The source of this right is Cedar Draw which during much of the year is comprised mostly of waste water from the Twin Falls Canal Co system. The waste water diverted under this right is subject to the right of the original appropriator, in good faith and in compliance with state laws governing changes in use and/or expansion of water rights, to cease wasting water, to change the place of use or manner of wasting it, or to recapture it.
The Director retains jurisdiction over this right to establish a minimum bypass flow, either upon request or on his own volition. A request for a minimum bypass flow must describe the values to be preserved and the bypass flow rate necessary to preserve the values. If the Director determines that the bypass proposal is meritorious, a hearing will be scheduled to determine whether the request should be granted.
09E Water used under this right when discharged into a natural channel or subsurface system shall meet Idaho Water Quality Standards.
R55 This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.
