004 The issuance of this right does not grant any right-of-way or easement across the land of another.
01M After specific notification by the department, the right holder shall install a suitable measuring device or shall enter into an agreement with the department to determine the amount of water diverted from power records and shall annually report the information to the department.
220 The four (4) ponds established by the storage of water under this right shall not exceed a total capacity of 2.3 acre-feet or a total surface area of 0.75 acres.
X35 Rights 47-8366 and 47-8394 when combined shall not exceed a total diversion rate of 1.65 cfs, and a total annual maximum diversion volume of 3.5 af.
Rights 47-8366 and 47-8394 authorize the diversion of an annual total of 3.5 acre-feet to be used for the storage volume for eight ponds. Right 47-8394 provides 1.65 cfs for the aesthetic flow of water through the ponds.
