Conditions

Code	Condtions
124	Place of use is within the service area of the City of Twin Falls municipal water supply system as provided for under Idaho Law.
180	A map depicting the place of use boundary for this water right at the time of this approval is attached to this document for illustration purposes.
075	Irrigation of large projects such as parks, golf courses, or sports activities fields is not authorized under this right.
022	The daily diversion volume for non-domestic uses under this municipal right shall not exceed 2,500 gallons per use and the daily diversion volume for domestic uses under this right shall not exceed 13,000 gallons per dwelling in accordance with Section 42-111, Idaho Code.
028	After specific notification by the department, the right holder shall annually report the amount of water diverted to the department.
020	The diversion and use of water described in this right may be subject to additional conditions and limitations agreed to by the protestants, intervenors and the right holder under a separate agreement to which the Department is not a party. Because the Department is not a party, the Department is not responsible for enforcement of any aspect of the agreement not specifically addressed in other conditions herein. Enforcement of those portions of the agreement not specifically addressed in other conditions shall be the responsibility of the protestant and the water right holder.
R19	The right holder shall maintain a totalizing measuring device of a type approved by the Department as a part of the diverting works at each point of diversion.
	The right holder shall maintain an airline or similar device approved by the department to measure the water level in the four municipal wells that are described as follows: SESESE of Sec. 29, Twp 10S, Rge 17E; SESWSE of Sec. 29, Twp 10S, Rge 17E; NESESE of Sec. 14, Twp 10S, Rge 17E and NESESE of Sec. 14, Twp 10S, Rge 17E.
U45	The place of use does not include federal land.
226	To the extent necessary for administration between points of diversion for ground water, and between points of diversion for ground water and hydraulically connected surface sources, this right retains its original priority for well locations authorized under this right as identified in the license issued 06-30-2009.
004	This right does not grant any right-of-way or easement across the land of another.
T07	The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08	Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
