081 Use of water under this approval shall comply with applicable water quality standards of the Division of Environmental Quality of the Idaho Department of Health and Welfare.
T07 The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code.
The total instantaneous diversion of water from all points of diversion under Transfer 5684 shall not exceed 8.57 cfs. Approval of Transfer 5684 does not grant any right-of-way or easement for use of a delivery system owned by person(s) other than the right owner. The place of use is located within the service area of the city of Buhl. The point of diversion in Lot 1 (NENE), S01, T10S, R14E is located within the Twin Falls Groundwater Management Area and use of water with a temperature greater than 85 degrees Fahrenheit is not authorized under these rights. Approval of this transfer does not preclude the opportunity for review of the validity of water right(s) 47-02196, 47-02339 and 47-07191 in the ongoing Snake River Basin Adjudication.
01Q After specific notification by the department, the right holder shall measure the diversion or shall enter into an agreement with the department to determine the amount of water diverted from power records and shall annually report the information to the department.
T17 Prior to diversion of water under this approval, the right holder shall provide a means of measurement acceptable to the Department from all authorized points of diversion which will allow determination of the total rate of diversion.
