R55
This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.
052
Diversion and use of water under this right is subject to an annual use fee if rules are subsequently promulgated which provide for the submittal of the fee.
Two points of diversion are located within the SWNWNW, S21, T10S, R15E.
Place of use is locally known as Hafliger Dairy.
An air line for measuring groundwater levels shall be maintained in the well drilled in 1996 in the SWNWNW, S21, T10S, R15E.
The right holders shall measure and report diversions and groundwater levels as required by the department.
The right holders shall retain ownership of 93 shares of Twin Falls Canal Company water for mitigation purposes and shall comply with the terms of mitigation as the terms may be determined in the future by the department.
Determination of the beneficial use developed under this right was based upon a dairy operation of 1,800 milking cows and 1,400 non-milking cattle. Regulation of this right will not be based on the number of animals but upon, and in accordance with, the authorized maximum diversion rate and maximum annual diversion volume.
At each point of diversion supplying water for stockwater and/or commercial purposes the right holders shall maintain a measuring device that will measure the diversion rate and record the total volume of water diverted. A measuring device is not required for a point of diversion supplying water for domestic purposes only.
The maximum diversion volume is defined as the maximum allowable volume of water that may be diverted annually from the source under the right. The use of water confirmed by this right is limited to the amount that can actually be beneficially used.
Modifications to or variance from this license shall be made in accordance with the limits of Section 42-222, Idaho Code, or the applicable Idaho law.
