044 Use of water under this right is subject to policies set forth in the State of Idaho Water Plan, including Policy No. 5G.
The volume of water authorized to be diverted for fish propagation purposes shall not exceed that required for a non- commercial, recreational fishery. Constant diversion for this purpose requiring a surface flow discharge of effluent from the pond is not authorized. The total combined rate of diversion under this right and Right 47-07749 shall not exceed 3.79 cfs. Fish ponds facility volume = 486,000 cubic feet.
R01 A measuring device of a type approved by this Department shall be maintained as a part of the diverting works.
