This partial decree is subject to such general provisions necessary for the definition of the rights or for the efficient administration of the water rights as may be ultimately determined by the Court at a point in time no later than the entry of a final unified decree. Section 42-1412(6), Idaho Code.

Use of water under this right may be affected by an agreement between the protestant and the right holder.

Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.0 afa per acre at the field headgate for irrigation of the lands above.
Prior to diversion of water under this approval, the right holder shall provide a means for measurement acceptable to the Department from all authorized points of diversion which will allow determination of the total rate of diversion.
The right holder shall measure the amount of water diverted annually and report the information to the Department.
This right shall be administered between the applicant and the named protestants as if its priority date is one day junior to the most junior groundwater irrigation right of the protestants. That priority date for purposes of such administration shall be January 19, 1994.
The well(s) previously used under Rights 47-02296A and 47-07409A located within NESE, S23, T11S, R17E, shall be abandoned in a manner which complies with Department well abandonment rules within one (1) year of the date of this approval.
The original place of use under Rights 47-02296A and 47-07409A located within S1/2NE and N1/2SE, S23, T11S, R17E shall not be irrigated unless other water rights are provided.

This right is limited to the irrigation of 21.7 acres within the place of use described above in a single irrigation season.

Use of this right is combined with water from Salmon River Canal Co. Ltd.
