This right is limited to the irrigation of 159.4 acres within the authorized place of use in a single irrigation season.

Rights 45-80B, 45-81B, 45-85, 45-12456, 45-13489, and 45-13497 when combined shall not exceed a total diversion rate of 6.18 cfs and the irrigation of 387 acres.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 45B.

The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversions.

The operation and use of this water right is also subject to the terms and conditions of the Water Rotation Agreement (“Agreement”) entered into by certain users on 10 September, 1992. The Agreement was filed and recorded in the office of the Cassia County Recorder on 27 May, 1993 as Instrument No.: 224804; the provisions of such Agreement to apply fully to this water right.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.0 afa per acre at the field headgate for irrigation of the lands above.

The approval of transfer #74087 redefines all of the elements of this water right, and the new use of water authorized by this approval shall constitute the full extent of the right.

The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
