IT IS THEREFORE HEREBY ORDERED That Application for Transfer No. 69152 is PARTIALLY APPROVED adding a point of diversion and modifying the place of use under Right 45-7733 as described on the Transfer Approval issued in conjunction with this order. IT IS FURTHER HEREBY ORDERED that Water Right 36-7870A has been FORFEITED through more than five consecutive years of non-use.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code.
WB4 The total instantaneous diversion of water from all points of diversion under Right 45-7733 shall not exceed 0.33 cfs, nor total combined annual volume of 128.0 af.
067 The right holder shall measure and annually report diversions of water and/or other pertinent hydrologic and system information as required by Section 42-701, Idaho Code.
082 The dairy operation authorized under this approval shall comply with applicable county zoning and use ordinances.
106 Use of water under this approval shall comply with applicable water quality standards of the Department of Environmental Quality.
WD8 The place of commercial use authorized by this approval includes land upon which wastewater may be applied for irrigation purposes to satisfy water quality requirements. Water diverted under this approval shall not be used for irrigation unless the water is first used in the dairy as authorized by this water right.
T07 The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T09 Approval of this transfer does not preclude the opportunity for review of the validity of the water right(s) in the ongoing Snake River Basin Adjudication.
