Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 45C.

The diversion and use of water described in this right may be subject to additional conditions and limitations agreed to by the protestant(s) and the right holder under separate agreement to which the Department is not a party and which may be enforceable by a court of law.

The right holder shall maintain a totalizing measuring device of a type approved by the Department as part of the diverting works and shall maintain a suitable measuring device as determined by the Department at the point effluent water is discharged to Trapper Creek.
Heating use is for 4 homes and a hot tub.

Domestic use is for 4 homes and does not include lawn, garden, landscape, or other types of irrigation.
Effluent discharged to Trapper Creek shall be treated, if necessary, to insure that the effluent meets Idaho Water Quality Standards.

This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.
