R55 This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.
R56 Diversion and use of water under this right is subject to an annual use fee if rules are subsequently promulgated which provide for the submittal of the fee.
The right holder shall use the full allotment of appurtenant surface water rights, to the extent they are available, in conjunction with groundwater diverted pursuant to this right. This right to divert groundwater shall not be used if the surface water right(s) appurtenant to the place of use is sold, transferred, leased or used on any other place of use without the approval of the Department. Right 45-07171 is also diverted through the point of diversion described above. Use of this right with Right 45-07171 is limited to a total combined diversion rate of 2.48 cfs and a total combined annual diversion volume of 1052.7 af. This right is limited to the irrigation of 102 acres within the place of use described above in a single irrigation season. This right when combined with Right 45-07171 and all other rights shall provide no more than .02 cfs per acre nor exceed a combined annual diversion volume of 1372.0 af for the lands above.
