Rights 45-11928 and 45-13421 when combined are limited to a total diversion rate of 0.11 cfs and a total diversion volume of 76 af measured at the stream headgates. Of the 76 af, 56 af is limited to stockwater use and 20 af is limited to use for maintaining pipeline flow and must be returned to the creek.
N13 The quantity of water under this right shall not exceed 13,000 gallons per day.
01R Prior to diversion the right holder shall install and maintain a measuring device with volumetric totalizer of a type acceptable to the Department as part of the stockwater delivery system and a measuring device with volumetric totalizer on the discharge pipe returning flows to the creek. The meter readings shall be recorded monthly and made available to the department upon request.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
