This partial decree is subject to such general provisions necessary for the definition of the rights or for the efficient administration of the water rights as may be ultimately determined by the Court at a point in time no later than the entry of a final unified decree. Section 42-1412(6), Idaho Code.
P21
This right is a split from former right 45-94.
S21
Use of this right is combined with water from Oakley Canal Co.
E55
Right Nos. 45-10791, 45-10792, 45-10793, 45-10794, 45-13600 and 45-13601 are limited to the irrigation of a combined total of 28.6 acres in a single irrigation season.
Water is stored pursuant to agreement with the Oakley Canal Company, which agreement may be subject to future modification or termination.
Future modifications of the agreement with the Oakley Canal Company, if any, shall not result in enlargement of this right.
Pursuant to agreement with the Oakley Canal Company water is stored under this right from April 15 to July 20 inclusive whenever Goose Creek water rights with a priority date of 4/1/1876 are in priority (deliverable).
The storage volume is calculated by multiplying the historic diversion rate of 0.0188 cfs by 1.9835 times the number of days the right is in priority (deliverable).
Water is rediverted under this right from Goose Creek into the West Canal and the East Canal.
C04
Right includes accomplished change in purpose of use pursuant to Section 42-1425, Idaho Code.
Pursuant to agreement with the Oakley Canal Company, irrigation water is stored and delivered from April 15 to July 20 inclusive.
This right was previously decreed in the Okleberry v. Karlson Decree (Third District Court, Cassia County, entered September 14, 1886) and the Botzet v. Chapin Decree (Fourth District Court, Cassia County, entered April 9, 1892). Quantities attributable to certain subsequent splits of ownership were determined by the Idaho Department of Reclamation in a Memorandum dated May 19, 1931.
