206 Rights 43-193, 43-194, 43-195, 43-293A, 43-296A, 43-302, 43-2361, 43-2422, 43-10238, 43-12960, 43-12994, and 43-12995 are limited to the irrigation of a specific 798.0 acres within the 826.0 acre place of use authorized by this right in a single irrigation season. The specific 798.0 acres to be irrigated by the right holder are shown in the electronic shape file associated with this right in the geographic information system component of the water rights database maintained by the department. Before changing the 798.0 acres to be irrigated within the 826.0 acre place of use, the right holder shall submit a new land list and representative electronic shape file or map to the Department prior to the irrigation season in which the change will occur.
R60 This right when combined with all other rights shall provide no more than 4.0 afa per acre at the field headgate for irrigation of the place of use.
192 When water is diverted under this right at the Point of Diversion, located in TWP 12S RNG 26E Sec. 25 NESE, the watermaster shall deliver 0.16 cfs from the following rights: 43-293A, 43-296A, 43-302, and 43-12994 into the Point of Diversion, located in TWP 13S RNG 26E Sec. 14 NENENE to mitigate for injury to other water users which have historically relied on sharing ditch loss with the right owner. Future adjustment to the amount needed for mitigation may be made by IDWR if improved conveyance loss analysis is developed. If water use from the headgate located in TWP 13S RNG 26E Sec. 14 NENENE is curtailed the mitigation requirement ceases.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 43C.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
K02 This right is based upon an enlargement of Rights 43-293A, 43-296A, and 43-302 pursuant to Section 42-1426, Idaho Code.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
