Right 41-4013B is also recorded as Right 01-10570 to identify the diversion of Fall Creek water from the Snake River as a result of Transfer approval 3700 and 76277. These duplicate rights represent a single use of water as described on either right.
The use of water under this right is limited to those times when sufficient water is available at the mouth of Fall Creek to satisfy this right.
X27 This right is limited to the irrigation of 80 acres within the place of use described above in a single irrigation season.
X35 Rights 41-51B/01-10569 and 41-4013B/01-10570 when combined shall not exceed a total diversion rate of 1.60 cfs, and the irrigation of 80 acres.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 01.
R43 The right holder shall maintain a totalizing measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion.
