Use of water under this right may be affected by an agreement between the protestant and the right holder.

Point of diversion and place of use are located within Lot 8, Buckhorn Subdivision, 1st Addition.

After specific notification by the department, the right holder shall install a suitable measuring device or shall enter into an agreement with the department to determine the amount of water diverted from power records and shall annually report the information to the department.

Use of water under this water right will be regulated by the watermaster of State Water District No. 37.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
The right holder shall install and maintain a lockable device of a type acceptable to the Department in a manner that will provide the watermaster suitable control of the diversion.
This right is approved in conjunction with an exchange of surface water right which will remain in the Big Wood River pursuant to the exchange provisions in Section 42-105, Idaho Code.
