Use of water under this right shall be non-consumptive.

The 10 ponds established by the storage of water under this right shall not exceed a total capacity of 26.7 acre-feet or a total surface area of 6.7 acres.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 37.
Upon specific notification by the Department a lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the diversion.
Diversion to storage from wells pumping groundwater shall not exceed 9.77 cfs when combined with Right 37-00466.
No diversion of groundwater shall occur in excess of flow of Deer Creek at the measuring device located within SESW, S26, T03N, R17E.
In addition to measuring devices required under diversion of Right 37-00466, the Department retains jurisdiction to require measuring devices, acceptable to the Department, on each of the ten storage facilities listed.

Rights 37-446, 37-11329 and 37-8748 when combined shall not exceed a total ground water diversion rate of 9.78 cfs.
