Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 37.

A lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the diversion.

The right holder shall permanently install and maintain a staff gage acceptable to the Department to provide a means to measure the pond or reservoir level on a constant basis.

Upon future notification the right holder shall provide a means acceptable to the department to measure the amount of water entering the reservoir and the amount of water released from the reservoir.

Right 37-8739 authorizes the storage of an annual total of 12 acre-feet, comprised of 7.2 acre-feet to be used for the initial filling or carryover storage of the reservoir, 2 acre-feet for the replacement of losses due to evaporation, and up to 2.8 acre-feet for additional refills for irrigation from storage use.

The reservoir established by the storage of water under this right shall not exceed a total capacity of 7.2 acre-feet or a total surface area of 1.2 acres.

This right when combined with all other rights shall provide no more than 0.03 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the place of use.

This right when combined with all other rights shall provide no more than 5.0 afa per acre for irrigation storage and irrigation from storage for the place of use.

This right is for the use of trust water, and it is subject to review 20 years after its initial approval (date of permit approval) to re-evaluate the availability of trust water for the authorized use and to re-evaluate the public interest criteria for reallocating trust water.

When the minimum stream flow water rights in the Snake River at Murphy Gage are not being satisfied, the right holder shall cease diverting water for the consumptive uses authorized by this right. The minimum stream flow water rights are for 3,900 cfs from April 1 through October 31 and 5,600 cfs from November 1 through March 31. See IDAPA 37.03.08.030.
The point of rediversion is from two pumps in Seamans Creek, both located in the NWNE of Sec. 32, T02N, R19E in Blain County.
