To prevent injury to other water right holders, the right holder shall cease diverting 5.00 cfs of this right from groundwater. If the mitigation portion of this right is used for any purpose other than conveyance loss, then water shall not be diverted under Right 37-23430. If the mitigation portion of this right is not deliverable due to a shortage of water or a priority call, then the amount of water authorized for diversion under the uses of Right 37-23430 that are being mitigated shall be reduced by the same proportion as the reduction to this right.
This right provides water to the ponds associated with right 37-8569.
R05

R43
The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
X35

Use of water under this right shall be non-consumptive.
The holders of senior water rights may seek review and amendment of this license in the event the withdrawal of groundwater pursuant to the license adversely affecting the senior water right holders or water rights for the Hayspur Hatchery. The burden of proof shall be upon the persons seeking such review and amendment.
The Director of the Department of Water Resources retains jurisdiction over this right to require compensation to other rights, or to the hydrologic system for losses which may occur as a result of this use.
