Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 130.

Prior to the diversion and use of water under Transfer approval 70250, the right holder shall install and maintain acceptable measuring device(s), including data logger(s), at the authorized point(s) of diversion, in accordance with Department specifications.

The right holder shall measure and annually report diversions of water and/or other pertinent hydrologic and system information as required by Section 42-701, Idaho Code.

This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.

Diversion and use of water under this right is subject to an annual use fee if rules are subsequently promulgated which provide for the submittal of the fee.

Prior to the diversion and use of water under this approval, the right holder shall comply with applicable water quality standards of the Department of Environmental Quality.

The commercial use authorized by this approval includes water for 8 homes, 7 lawns, a potato cellar, and a dairy barn.

The total instantaneous diversion of water from all points of diversion under Rights
37-8487B, 37-8487C and 37-12787A shall not exceed 0.74 cfs, nor total combined annual volume of 169.0 af.
This right is subject to the previous approval of Transfer No. 68319 and to the following condition contained in an agreement dated 10-12-95 between Jacob F. Bosma and Lorna Bard whereby the domestic well, which is the subject of an 04-30-87 agreement with the Travelers Insurance Company, will not be used for dairy purposes except for a reasonable time in the event of an emergency caused by the failure of the primary water system. However, in no event can diversions under Right No. 37-08487B leave Lorna Bard or her successors without water.
This right is subject to the previous approval of Transfer No. 68319 and to the following condition contained in an agreement dated 10-20-95 between Jacob F. Bosma (Applicant) and Daniel Butler representing Spring Cove Ranch, Inc. and Archie Walker (Protestants): "...The Applicant shall continuously comply with the practices specified in the Plan and Agreement entered into by the Protestants and Applicant, and in the event a party to that Agreement shall hereafter in a contested case establish that it is more probable than not that the Applicant has materially failed to comply with the Agreement, this transfer and approval shall be revoked."

The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
