This partial decree is subject to such general provisions necessary for the definition of the rights or for the efficient administration of the water rights as may be ultimately determined by the Court at a point in time no later than the entry of a final unified decree. Section 42-1412(6), Idaho Code.
903
The maximum diversion volume is defined as the maximum allowable volume of water that may be diverted annually from the source under this right. The use of water confirmed by this right is limited to the amount that can actually be beneficially used. The maximum diversion volume may be adjusted to more accurately describe the beneficial use or to implement accepted standards of diversion and use efficiency.
027
Use of water under this right shall be non-consumptive.
The right holder shall install and maintain a measuring device and lockable controlling works of a type acceptable to the Department as part of the diverting works.
005
Use of water under this right is subject to control by the watermaster of State Water District No. 37.
Upon future determination that the use of water is consuming water required to satisfy prior rights, the right holder will be required to discontinue diversion under this right or provide supplemental water from a source approved by the Department.
Measuring devices shall be maintained at the point of diversion from Willow Creek and at the outlet of the reservoir.
Return water shall be treated to insure that the effluent meets Idaho Water Quality Standards.
