194 To mitigate for the effects of transferring groundwater rights 37-23407 (via Transfer # 87653), 37-23410 (via Transfer # 87653), 37-8209 (via Transfer # 87657), 37-8080 (portion being transferred renumbered to 37-23460 via Transfer # 87658), 37-22546 (portion being transferred renumbered to 37-23461 via Transfer # 87659), 37-22547 (via Transfer # 87659), and 37-7745C (portion being transferred renumbered to 37-23465 via Transfer # 87660) on Idaho Water Resource Board minimum stream flow rights 37-7919 and 37-8307, the right holder shall cease diverting and using a 0.04 cfs, 7.0 AF, and 2.0 acre portion of this right, which shall remain undiverted.
R63 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
R05 Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 37.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
933 This right is for the use of trust water, and it is subject to review 20 years after its initial approval (date of permit approval) to re-evaluate the availability of trust water for the authorized use and to re-evaluate the public interest criteria for reallocating trust water.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
