01M After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water diverted and shall annually report the information to the Department.
Heating use is for melting snow and ice on driveways and walkways and for space heating in one home and one bath house. The heating use shall be non-consumptive.
Recreation use is for heating a pond filled initially from another water source.
Water used solely for heating purposes and water used for the non-consumptive component of the recreation use shall either be injected into the groundwater or discharged to a natural stream.
R07 Return flow discharged to a subsurface system must be authorized by a separate injection well permit and if return flow is discharged to a surface water system shall meet Idaho Water Quality Standards.
F06 The following rights are diverted through the points of diversion described above bearing metal ID tags #D0050559 and #D0050560: 37-8205 and 37-22128.
170 To mitigate for the depletion of water resulting from the use of water under this right and to prevent injury to senior water right holders, the right holder shall cease diverting and using water as authorized by the following water rights for the purposes and amounts specified below. Moreover, the official record for the following water right will be changed to show that diversion and use of water is not authorized because the portion of the right is being dedicated to mitigation purposes. Use Changed Mitigation Right No. to Mitigation Volume (AF) 37-4369 Recreation Storage 2.3 In addition, the following statement shall be added to right no. 37-4369: The surface area of the reservoirs established in connection with this right shall not exceed 11.8 acres.
