R05 Use of water under this right will be regulated by the watermaster of State Water District No. 37.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
X53 Diversion of groundwater is limited to those times water is available for diversion under this right and priority from the Big Wood River.
Aesthetic and recreation use is for flow through a channel including three ponds with a combined surface area of 1.2 total acres.
Total consumptive volume is limited to 150 acre feet annually.
225 Any transfer of the point(s) of diversion described under this right will require the right holder to provide evidence that the new point(s) of diversion has a direct and immediate hydraulic connection to the Big Wood River.
The new ground water diversions authorized by the approval of this transfer (#87533), at the time of construction shall be located within 70 feet of the Big Wood River.
004 This right does not grant any right-of-way or easement across the land of another.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
