E52 USE OF THIS RIGHT WITH RIGHTS LISTED BELOW IS LIMITED TO A TOTAL COMBINED DIVERSION RATE OF 2.5 CFS. COMBINED RIGHT NOS.: 37-351C & 37-8726.
R04 Use of water under this water right will be regulated by the watermaster of State Water District No. 37M.
A measuring device and lockable controlling works of a type acceptable to the Department shall be permanently installed and maintained as part of the diverting works prior to the diversion of water. Fish screens acceptable to the Idaho Department of Fish and Game must be installed at the diversion works and at the outlet works prior to diversion of water. The Director retains jurisdiction over this right to require installation of a measuring device in Silver Creek to insure maintenance of a minimum stream flow of 74 cfs in Silver Creek. Right Nos. 37-00351C and 37-00352C provide mitigation water to prior rights in connection with diversion of water under Right No. 37-08726.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
