To mitigate for injury to other water users caused by the diversion and use of water under this right, a river loss of 15% is assessed, the watermaster shall only deliver 0.34 cfs of this right at the point of diversion leaving 0.06 cfs in the river. |

The specific 68 acres to be irrigated by the right holder shall be identified prior to use by submittal of a land list and a representative electronic shape file or by submittal of a land list and a map sufficiently detailed to allow creation of an electronic shape file to be associated with this right in the geographic information system component of the water rights database maintained by the department. Before changing the 68 acres to be irrigated within the 558.6 acre place of use, the right holder shall submit a new land list and representative electronic shape file or map to the Department prior to the irrigation season in which the change will occur. |

The rights in Transfers #75838 (37-1207), #75839 (37-310A, 37-19831), and #75840 (37-180, 37-181, 37-231A, 37-233), when combined are limited to the irrigation of a specific 547.6 acres within the 766.3 acre combined place of use in Sections 15, 21, 22, 26, 27, and 28 authorized by these rights in a single irrigation season. The specific 547.6 acres to be irrigated by the right holder shall be identified prior to use by submittal of a land list and a representative electronic shape file or by submittal of a land list and a map sufficiently detailed to allow creation of an electronic shape file to be associated with these rights in the geographic information system component of the water rights database maintained by the department. Before changing the 547.6 acres to be irrigated within the 766.3 acre place of use, the right holder shall submit a new land list and representative electronic shape file or map to the Department prior to the irrigation season in which the change will occur. |

The diversion and use of water described in this right may be subject to additional limitations agreed to by the protestant(s) and the right holder under the Stipulation to Resolve Protests dated January 20, 2011 to which the Department is not a party and which may be enforceable by a court of law. |

The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval. |

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer. |

Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree. |
