Code Condtions
This right in combination with all other right for irrigation of the lands above shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre, measured at the field, when water is applied via pump and pressurized irrigation system.
X35 Rights 37-2683A and 37-7349A when combined shall not exceed a total diversion rate of 2.33 cfs, a total annual maximum diversion volume of 390.1 af at the field headgate, and the irrigation of 120.2 acres.
X27 This right is limited to the irrigation of 60.2 acres within the place of use described above in a single irrigation season.
X35 Rights 37-2683A, 37-7349A, 37-22550, 37-22552, 37-22554, 37-22556, 37-22558, 37-22560, 37-22562, 37-22564, 37-22566, and 37-22572 when combined shall not exceed the irrigation of 154.1 acres.
X11 Prior to the diversion and use of water under this right, the right holder shall install and maintain acceptable measuring devices at the point of injection into and at the point of rediversion from Silver Creek.
R02 A lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the rediversions from Silver Creek.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 37M.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code and applicable Well Construction Rules of the Department.
01M After specific notification by the Department, the right holder shall install a suitable measuring device or shall enter into an agreement with the Department to use power records to determine the amount of water divertedfrom the wells and shall annually report the information to the Department.
004 This right does not grant any right-of-way or easement across the land of another.
F06 The following rights are diverted through point(s) of diversion described above within TWP 01S, RNG 21E, Sec 20: 37-2444, 37-2683A, 37-2683B, 37-7349A, 37-7349B, 37-21942, 37-22560, 37-22562, 37-22564, 37-22566 and 37-22572.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
