This partial decree is subject to such general provisions necessary for the definition of the rights or for the efficient administration of the water rights as may be ultimately determined by the Court at a point in time no later than the entry of a final unified decree. Use of water under this water right will be regulated by the watermaster of State Water District No.37.

This right when combined with all other rights shall provide no more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
Prior to the diversion and use of groundwater under this right, the right holder shall install and maintain measuring devices acceptable to the watermaster and the department at both the point of diversion at the well and the point of injection into Chaney Creek.
The portion of Right 37-02609A used for conveyance losses for irrigation use is 0.04 cfs.
The first year that water is diverted to wildlife, recreation and aesthetic storage uses, the irrigation use under this right shall be limited to 8.7 acres, 0.34 cfs and 30.5 afa.
The reduction of irrigation during the first year will provide the additional storage volume to fill the pond when combined with the 4.2 af associated with the 1.2 acres no longer irrigated.
During initial filling of the pond, the right holder shall inject groundwater into Chaney Creek at a rate not to exceed 0.50 cfs when all uses of the right are combined in order to replace captured surface water as soon as possible.
After the initial filling of the pond, the right holder shall continue to divert groundwater into Chaney Creek at a diversion rate of 0.02 cfs and an annual diversion volume of 3.1 af to replace consumptive losses of the pond.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
