When combined these rights shall also not exceed a total diversion rate of 0.01 cfs and a total annual maximum diversion volume of 0.2 af at the point of diversion for stockwater purposes. |

The specific 28.4 acres to be irrigated by the right holder shall be identified prior to use by submittal of a land list and a representative electronic shape file or by submittal of a land list and a map sufficiently detailed to allow creation of an electronic shape file to be associated with this right. Before changing the 28.4 acres to be irrigated within the 31.8 acre place of use, the right holder shall submit a new land list and representative electronic shape file or map to the Department prior to the irrigation season in which the change will occur. |

When water is diverted under this right at the Point of Diversion, located in TWP 01S, RNG 20E, Sec. 20 NESW, the watermaster shall deliver 0.01 cfs from the following rights: 37-23604, 37-23605, 37-23606, 37-23607, 37-23608, 37-23609, 37-23610, 37-23611, 37-23612, 37-23613, 37-23614, 37-23615, 37-23616, 37-23617, 37-23618, 37-23620, 37-23621, 37-23622, 37-23623, and 37-23626 into the point of diversion, located in TWP 01S, RNG 19E, Sec. 24 NESENW, locally known as the Gillihan Ditch, to mitigate for injury to other water users which have historically relied on sharing ditch loss with the right owner. Future adjustment to the amount needed for mitigation may be made by IDWR if improved conveyance loss analysis is developed. If water use from the headgate located in TWP 01S, RNG 20E, Sec. 20 NESW is curtailed the mitigation requirement ceases. |

The Silver Creek point of diversion located in TWP 01S, RNG 20E, Sec. 20 NESW is limited to a maximum diversion rate of 0.10 cfs, when diverted under rights 37-23604, 37-23605, 37-23606, 37-23607, 37-23608, 37-23609, 37-23610, 37-23611, 37-23612, 37-23613, 37-23614, 37-23615, 37-23616, 37-23617, 37-23618, 37-23620, 37-23621, 37-23622, 37-23623, and 37-23626. |

The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval. |
| T08 |
Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer. |

Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014. |
