Code Condtions
The rights listed below, shall provide nor more than 3.5 afa per acre at the field headgate for irrigation of the lands in the place of use whenever sprinkler methods of irrigation are used. Combined Right Nos. 337-22773, 37-22774, 37-22775 and 37-22776.
This right is a split from former right 37-21815.
G05 Water diverted from Headgate #22 delivered through Hiawatha Canal.
E55 Right Nos. 37-22773, 37-22774, 37-22775 and 37-22776 are limited to the irrigation of a combined total of 14.1 acres in a single irrigation season.
The diversion rate of this right is .387 cfs.
C18 This partial decree is subject to such general provisions necessary for the definition of the rights or for the efficient administration of the water rights as may be ultimately determined by the Court at a point in time no later than the entry of a final unified decree. Section 42-1412(6), Idaho Code.
This right mitigates for the depletion of water resulting from the diversion and use of water under Rights 37-22825 and 37-22831. A total of 0.147cfs of this right is changed from irrigation use on 8.7 acres to mitigation use. To prevent injury to other water right holders, the right holder shall cease diverting 0.118 cfs of this right from the Big Wood River and cease irrigation of 8.7 acres. In addition, 0.029 cfs of this right shall be delivered into the Hiawatha Canal to prevent injury to water right holders within the Hiawatha Canal system.
