C18 This partial decree is subject to such general provisions necessary for the definition of the rights or for the efficient administration of the water rights as may be ultimately determined by the Court at a point in time no later than the entry of a final unified decree. Section 42-1412(6), Idaho Code.
164 The capacity of the storage reservoir is 50 AF. The reservoir may be refilled multiple times in a single year.
K02 This right is based upon an enlargement of Right No. 37-22116 pursuant to Section 42-1426, Idaho Code.
K06 This right is limited to the irrigation of 333.2 acres within the place of use described above in a single irrigation season.
C11 This water right is subordinate to all water rights with a priority date earlier than April 12, 1994, that are not decreed as enlargements pursuant to Section 42-1426, Idaho Code. As between water rights decreed as enlargements pursuant to Section 42-1426, Idaho Code, the earlier priority right is the superior right.
193 This right mitigates for the depletion of water resulting from the diversion and use of water under Right 37-22597. To prevent injury to other water right holders, the right holder shall cease diverting 0.5 acre feet of this right from Copper Creek. The land dried up for mitigation that will no longer be irrigated under this right (3.5 acres) is located within the SWSE, Section 16, T01N, R23E. If the mitigation portion of this right is not deliverable due to a shortage of water or a priority call, then the amount of water authorized for diversion under the uses of Right 37-22597 that are being mitigated shall be reduced by the same proportion as the reduction to this right.
