Code Condtions
R05 Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 37.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversions.
219 Rights 37-510A, 37-685D, 37-21842, 37-21849, 37-21866, 37-21883, 37-21900 and 37-21917 authorize total annual storage volume of 81.9 acre-feet, 70.3 acre-feet to be used for the initial filling or carryover storage of the reservoir and 11.6 acre-feet for the replacement of losses caused by seepage and evaporation.
Right Nos. 37-510A and 37-685D are also used for storage of water in the pond for recreation. The pond used for storage of water for recreation under 37-510A, 37-685D, 37-21842, 37-21849, 37-21866, 37-21883, 37-21900 and 37-21917 shall not exceed a total capacity of 70.3 acre-feet or a total surface area of 14.9 acres.
Rights 37-21842, 37-21849, 37-21866, 37-21883, 37-21900, and 37-21917 authorize the diversion of an annual total of 11.6 acre-feet to be used for the storage of water in the pond to replace losses caused by evaporation from the pond.
Rights Nos. 37-510A, 37-685D, 37-21842, 37-21849, 37-21866, 37-21883, 37-21900, and 37-21917 are limited to a combined diversion rate of 4.40 cfs.
The right holder shall maintain an earthen liner in the pond to minimize seepage losses.
The right holder shall make full beneficial use of all surface water rights available to the right holder for the recreational pond. The right holder shall limit the diversion of ground water under Water Right 37-21842 to those times when the surface water supply is not available or the surface water supply is not reasonably sufficient to supply the recreation pond authorized under these rights.
Point of diversion described above is the headgate for District 45 canal.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
