R55 This right is for the use of trust water and is subject to review 20 years after the issuance of the permit to determine availability of water and to re-evaluate the public interest.
R05 Although the source of water is not currently regulated by a watermaster, use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 37.
18C After specific notification by the Department, the right holder shall provide a means acceptable to the department to measure the amount of water entering the reservoir and the amount of water released from the reservoir.
X38 Use of water under this right shall be non-consumptive. At such time in the future as the Director determines necessary to protect the prior rights of other users, the Director may require determination of the rate of loss within the system using a procedure approved by the Director, and may require mitigation for all system losses.
Wildlife storage, recreation storage, and aesthetic storage uses are for a pond.
Water diverted from the spring sources under this right is injected into the unnamed stream at the point(s) of injection in the SWSE, Sec 19, Twp 2N, Rge 18E and L5, Sec 30, Twp 2N, Rge 18E and impounded at the point of rediversion in the SESW, Sec 19, Twp 2N, Rge 18E.
The diversion to storage authorized under this right is for spring sources only.
