Code Condtions
The Department retains jurisdiction over this right to require the right holder to determine the rate of loss within his facility using a procedure approved by the Director of the Department of Water Resources, and provide a source of augmentation water to mitigate all losses if necessary. The source is also known as Thompson Springs. The facility volume is 12,890 cubic feet.
09D Water used under this right if discharged into a natural channel shall meet Idaho Water Quality Standards.
044 Use of water under this right is subject to policies set forth in the State of Idaho Water Plan, including Policy No. 5G.
004 The issuance of this right does not grant any right-of-way or easement across the land of another.
042 The right holder shall provide the Department, upon request, information showing volume changes per hour necessary to maintain an adequate environment for the fish propagation facility. Volume changes per hour shall be based upon actual fish production.
