T17 Prior to diversion of water under this approval, the right holder shall provide a means of measurement acceptable to the Department from all authorized points of diversion which will allow determination of the total rate of diversion.
T07 The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.
067 The right holder shall measure and annually report diversions of water and/or other pertinent hydrologic and system information as required by Section 42-701, Idaho Code.
068 This permit does not authorize the construction of any new well or the deepening or enlargement of any existing well.
The total instantaneous diversion of water from all points of diversion under Transfer 5368 shall not exceed 0.49 cfs, nor a total combined annual volume of 83.1 af. Other rights diverted from these points of diversion include Rights 36-08532, 36-08533, 36-11043, 36-11044 and 36-14830. The capacity of the three wells is limited to a combined total of 0.59 cfs, and the total annual diversion volume shall not exceed 127.5 af when combining all rights diverted from the three wells. Commercial use is for a dairy located within the NWNE and NENW, S09, T08S, R17E, which does not include the waste disposal site.
082 The dairy operation authorized under this approval shall comply with applicable county zoning and use ordinances.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
081 Use of water under this approval shall comply with applicable water quality standards of the Division of Environmental Quality of the Idaho Department of Health and Welfare.
