Code Condtions
X35 Rights 36-6 and 36-7 when combined shall not exceed the irrigation of 21 acres.
The portion of this right in excess of 1.08 cfs for irrigation is subordinated to all water rights with priority dates earlier than December 31, 1999.
The subordinated portion of this water right shall not be asserted, delivered, honored, used, enforced, effective or otherwise recognized as valid if it would cause or require, either directly or indirectly, curtailment of, injury to, or mitigation from any water rights with priority dates earlier than December 31, 1999. The subordinations shall run with and be perpetual servitudes upon this water right and the associated lands, including any new lands to which all or any portions of this water right is transferred.
The portion of this right for wildlife use is subordinated to all water rights with priority dates earlier than December 31, 1999.
0.08 cfs of the unsubordinated irrigation portion of this right is limited to use for conveyance losses in the delivery of this right.
The irrigation use under this right in excess of 1.08 cfs is subordinated to all water rights with priority dates earlier than December 31, 1999.
The wildlife use under this right is subordinated to all water rights with priority dates earlier than December 31, 1999.
N05 The quantity of water under this right for stockwater use shall not exceed 13,000 gallons per day.
N08 The quantity of water decreed for this water right for stockwater use is not a determination of historical beneficial use.
Water is delivered through the Sands Ditch.
R05 Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 36A.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
