Combined Right Nos. 36-02247B and 36-08047B are limited to the diversion rate of 0.70 cfs, annual diversion volume of 123.8 af for stockwater and commercial uses in connection with a dairy. Stockwater uses under Right Nos. 36-02247B and 36-08047B are limited to a dairy operation no larger than 1,600 milking cows, 330 dry cows and 700 head of replacement calves and heifers. Use of water under Transfer No. 4494 shall comply with applicable water quality standards of the Division of Environmental Quality of the Idaho Department of Health and Welfare. Two (2) points of diversion for dairy use under Right Nos. 36-02247B and 36-08047B, and one (1) point of diversion for irrigation use under Right Nos. 36-02247A and 36-08047A are located within the NENE, S11, T08S, R14E. Prior to diversion of water from all points of diversion under Transfer No. 4494, the right holder shall install measuring devices to measure the amount of water diverted and shall annually report the diversion to the department. The right holder shall obtain prior approval from the department of the type of measuring device to install. The portion of Right No. 36-08047 described as 0.18 cfs and 9.0 acres has been abandoned through approval of Transfer No. 4494 and any portion of the rights described under this approval that are not developed within 5 years shall be forfeited. Commercial use under Right Nos. 36-02247B and 36-08047B is for a dairy.
T09 Approval of this transfer does not preclude the opportunity for review of the validity of the water right(s) in the ongoing Snake River Basin Adjudication.
T07 The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code.
