The first year that water is diverted to recreation storage use, the irrigation use under Rights 35-28 and 35-29 shall be limited to 50.7 acres, 0.57 cfs and 202.8 afa.

Use of water under this water right will be regulated by the watermaster of State Water District No. 01.
The reduction of irrigation during the first year will provide the additional storage volume to fill the ponds when combined with the 175.2 af associated with the 43.8 acres no longer irrigated.

The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.0 afa per acre at the field headgate for irrigation of the lands above.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

The storage of water under this rights 35-28 and 35-29 is contingent upon the certification of the dam and authorization of storage per the dam safety provisions of the Idaho Code.

USE OF THIS RIGHT WITH RIGHT NO. 35-00029 IS LIMITED TO A TOTAL COMBINED DIVERSION RATE OF 0.93 CFS AND TO A TOTAL COMBINED ANNUAL DIVERSION VOLUME OF 248.8 AF AT THE FIELD HEADGATE FOR IRRIGATION.
USE OF THIS RIGHT WITH RIGHT NO. 35-00029 IS LIMITED TO A TOTAL COMBINED DIVERSION RATE OF 0.67 CFS AND TO A TOTAL COMBINED ANNUAL DIVERSION VOLUME OF 175.2 AF FOR RECREATION AND STORAGE USES.
USE OF THIS RIGHT WITH RIGHT NO. 35-00029 IS LIMITED TO THE IRRIGATION OF A COMBINED TOTAL OF 62.2 ACRES IN A SINGLE IRRIGATION SEASON.

THIS PARTIAL DECREE IS SUBJECT TO SUCH GENERAL PROVISIONS NECESSARY FOR THE DEFINITION OF THE RIGHTS OR FOR THE EFFICIENT ADMINISTRATION OF THE WATER RIGHTS AS MAY BE ULTIMATELY DETERMINED BY THE COURT AT A POINT IN TIME NO LATER THAN THE ENTRY OF A FINAL UNIFIED DECREE.
