T09 Approval of this transfer does not preclude the opportunity for review of the validity of the water right(s) in the ongoing Snake River Basin Adjudication.
Right 35-14208 when combined with Right 35-14206 shall not exceed a total diversion rate of 0.61 cfs. The total instantaneous diversion of water from all points of diversion under Transfer 5198 shall not exceed 3.50 cfs, nor a total combined annual volume of 1064 af. Right 35-14208 is limited to the irrigation of 32.2 acres in the place of use described above in a single irrigation season.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
R56 Diversion and use of water under this right is subject to an annual use fee if rules are subsequently promulgated which provide for the submittal of the fee.
R57 The Director retains jurisdiction of the right and may change, add, or remove any requirement as determined to be appropriate.
067 The right holder shall measure and annually report diversions of water and/or other pertinent hydrologic and system information as required by Section 42-701, Idaho Code.
046 Right holder shall comply with the drilling permit requirements of Section 42-235, Idaho Code.
R64 This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 4.0 afa per acre at the field headgate for irrigation of the lands above.
