This right is limited to the irrigation of 168 acres within the authorized place of use in a single irrigation season.

Rights 34-2428, 34-7247, and 34-12416 when combined shall not exceed a total diversion rate of 8.23 cfs from the well located in the NWSENE, Sec. 05, T04N, R26E (known as the Middle Well).

Diversion and use of water from the well located in NWSENE, Sec. 5, T04N, R26E (known as the Middle Well) under the following water rights shall be limited to the diversion of 1,953 acre-feet/annum; 34-2332, 34-2424B, 34-2428, 34-7035B, 34-7052, 34-7079, 34-7247, 34-12416, and 34-13841.

Rights 34-496A, 34-692D, 34-2428, 34-7035B, 34-7247, and 34-12416 when combined shall not exceed the irrigation of 945 acres.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the place of use.

Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 34.
Distribution of water for use under this right shall be in accordance with the Water District 34 rules including requirements for mitigation as therein provided. If mitigation is not provided to avoid injury to existing rights, the well shall be reconstructed to prevent water from any depth less than 300 feet from entering the well.

The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).

The issuance of this right does not grant any right-of-way or easement across the land of another.
