220 The two ponds established by the storage of water under rights 34-335, 34-336, 34-337, and 34-14968 shall not exceed a total capacity of 6.3 acre-feet or a total surface area of 1.1 acres.
219 Rights 34-335, 34-336, 34-337, and 34-14968 authorize total annual storage volume of 7.6 acre-feet, 6.3 acre-feet to be used for the initial filling or carryover storage of the ponds and 1.3 acre-feet for the replacement of losses caused by evaporation. Rights 34-335, 34-336, and 34-337 authorize a combined 1.3 acre-feet annual volume for the replacement of losses caused by evaporation.
R05 Use of water under this right may be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 34.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
S34 The period of use for irrigation described above may be extended in seasons of unusual characteristics to a beginning date of 04-20 and an ending date of 10-31 at the discretion of the Director of the Idaho Department of Water Resources.
004 This right does not grant any right-of-way or easement across the land of another.
T07 The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Idaho Code § 42-1412(6), this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as determined by the Snake River Basin Adjudication court in the final unified decree entered 08/26/2014.
