Water rights 34-13665, 34-14299, and 34-14301 mitigate for the depletion of water resulting from the diversion and use of water under water right 34-7511.
Ground water recharge is accomplished by diverting water under this right into an infiltration area that allows water to percolate into the underlying aquifer. To prevent the unauthorized above ground storage of water, the amount of water diverted and used for recharge under this right shall not exceed the actual infiltration capacity.
The right holder shall not receive any carryover credit from one year to the next for any volume of surface water recharged under water rights 34-13665, 34-14299, and 34-14301.
Ground water shall not be diverted under water right 34-7511 until an equivalent amount of surface water has been diverted into the recharge site under water rights 34-13665, 34-14299, and 34-14301 in the same year. The volume of ground water that may be diverted for irrigation under water right 34-7511 in any irrigation season shall not exceed the volume of surface water diverted into the recharge site during the same year.
R05
Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 34.
R43
The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s).
Prior to the diversion and use of water under Transfer 83703, the right holder shall install and maintain an acceptable measuring device at the point of delivery into the infiltration area used for ground water recharge, in accordance with Department specifications to determine the amount of water recharged annually and shall report the diversion volume to the Department by December 31 each year.
F01
Water is delivered to recharge site through Arco Canal.
S34
The period of use may be extended in seasons of unusual characteristics to a beginning date of 04-20 and an ending date of 10-31 at the discretion of the Director of the Idaho Department of Water Resources.
004
This right does not grant any right-of-way or easement across the land of another.
T07
The right holder shall accomplish the change authorized by this transfer within one year of the date of this approval.
T08
Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19
Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
