Rights 33-14873 and 33-14875 when combined shall not exceed a total annual maximum diversion volume of 609.7 af at the field headgate, and the irrigation of 126.5 acres.
Exchange water diverted from Wet Creek under rights 33-14873 and 33-14875 is limited to the irrigation of 35 acres in the NWNW Sec 9, Twp 9N, Rge 27E.
X35 Rights 33-87, 33-2034, 33-7179, 33-14871, 33-14873 and 33-13875 when combined shall not exceed a total diversion rate of 5.44 cfs, a total annual maximum diversion volume of 676 af at the field headgate, and the irrigation of 193.1 acres.
R05 Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 33.
Water diverted under rights 33-14873 and 33-14875 is injected into the Little Lost River at the point of injection then subject to conveyance loss adjustment by the watermaster is either exchanged with water diverted from Wet Creek at the point of exchange in Sec 5, Twp 9N, Rge 27E and/or rediverted from the Little Lost River at the point of rediversion in Sec 33, Twp 9N, Rge 27E.
Exchange water diverted from Wet Creek is based on 1.12 cfs of rights 33-14873 and 33-14875 being injected into the Little Lost River at the point of injection and flowing past the mouth of Wet Creek. When exchange water is being diverted from Wet Creek, the quanitity of water elligble for rediversion from the Little Lost River is based on the combined diversion rate of rights 33-14873 and 33-14875, not to exceed 4.05 cfs, being injected into the Little Lost River at the point of injection minus the quantity of water designated for exchange.
R43 The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion(s), point of exchange and point of rediversion.
The right holder must maintain a measuring device of a type approved by the Department to measure water at the point of injection.
R59 This right when combined with all other rights shall provide no more than 3.5 afa per acre at the field headgate for irrigation of the lands above.
004 This right does not grant any right-of-way or easement across the land of another.
T07 The right holder shall accomplish the change authorized by this transfer within one year(s) of the date of this approval.
T08 Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.
T19 Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
