This right is limited to the irrigation of 107.8 acres within the place of use described above in a single irrigation season.
The use of water under Rights 32-47 and 32-2010 shall be limited as follows:
(a) When the flow in Edie Creek at the point of diversion for Rights 32-47 and 32-2010
is equal to or less than 2.00 cfs, no water shall be diverted under Rights 32-47 and
32-2010.
(b) When the flow in Edie Creek at the point of diversion for Rights 32-47 and 32-2010
is greater than 2.00 cfs but less than 8.20 cfs, the amount of water in excess of
2.00 cfs may be diverted under Rights 32-47 and 32-2010.
(c) When the flow in Edie Creek exceeds the amount of 8.20 cfs, 6.20 cfs may be
diverted under Rights 32-47 and 32-2010.
The amount of water diverted under Rights 32-47 and 32-2010 shall never exceed the amount of water necessary for the reasonable beneficial use of the water.

Use of water under this right may be affected by an agreement between the protestant and the right holder.

Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 32C.

The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion.

This right when combined with all other rights shall provide no more than 0.02 cfs per acre nor more than 3.5 afa per acre at the field headgate for irrigation of the lands above.

This right does not grant any right-of-way or easement across the land of another.

The right holder shall accomplish the change authorized by this transfer within one (1) year of the date of this approval.

Failure of the right holder to comply with the conditions of this transfer is cause for the Director to rescind approval of the transfer.

Pursuant to Section 42-1412(6), Idaho Code, this water right is subject to such general provisions necessary for the definition of the rights or for the efficient administration of water rights as may be determined by the Snake River Basin Adjudication court at a point in time no later than the entry of the final unified decree.
