Use of water under this right will be regulated by a watermaster with responsibility for the distribution of water among appropriators within a water district. At the time of this approval, this water right is within State Water District No. 32C.

The right holder shall maintain a measuring device and lockable controlling works of a type approved by the Department in a manner that will provide the watermaster suitable control of the diversion.
The diversion and use of water from Irving Creek under Rights 32-13200 and 32-13202 shall be subordinate to other rights existing prior to July 30, 2001 from Irving Creek and its tributaries.

Diversion of water from Irving Creek is limited to those times water is available for diversion under this right and priority from Medicine Lodge Creek.

Prior to diversion of water under transfer 69321, the right holder shall provide a means of measurement acceptable to the department for measuring the flow in Medicine Lodge Creek at the original point of diversion and at the point of diversion from Irving Creek.

The Director retains jurisdiction for five (5) years to require a bypass flow for maintenance of fish, wildlife, riparian and aquatic habitat to address Department of Fish and Game concerns of potential impacts related to changes authorized under transfer 69321.

This right when combined with all other rights shall provide no more than 3.5 afa per acre at the field headgate for irrigation of the lands above.

The right holder shall accomplish the change authorized by transfer 69321 by September 30, 2003.

Failure of the right holder to comply with the conditions of transfer 69321 is cause for the Director to rescind approval of the transfer.
