R04 Use of water under this water right will be regulated by the watermaster of State Water District No. 29A.
R02 A lockable device subject to the approval of the Department shall be maintained on the diverting works in a manner that will provide the watermaster suitable control of the diversion.
Upon specific notification by the Department, the right holder shall install measuring devices acceptable to the Department in a manner that will provide the watermaster suitable control of the diversion.
At such time that the right holder or future owner of the residence shall modify the driveway approach to the residence that incorporates the dam and existing outlet device, the right holder shall modify the dam to include a fishway accommodating upstream and downstream movement of fish. In addition, at such time that downstream interferences with fish are identified and modified so that the South Fork Pocatello Creek can resume its trout recruitment function, the right holder shall proceed with fishway inclusion as advised by the Idaho Department of Fish and Game.
