Any well drilled pursuant to this right must be located at least 600 feet from any existing well. Well spacing closer than 600 feet must be approved by the department.
The right holder must ensure that a homeowner's association remains in place that actively enforces by-laws which set forth the water use restrictions.
All outside spigots on homes built in the subdivision must be contained in breakable enclosures and are only to be used in an emergency.
